Welcome to Rentalk. By accessing or using our mobile application and services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using Rentalk.

1. Acceptance of Terms

By creating an account, accessing, or using Rentalk, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services.

2. Eligibility

You must meet the following requirements to use Rentalk:

• Be at least 18 years of age
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using our services under applicable laws
• Provide accurate and complete registration information

3. Account Registration and Security

3.1 Account Creation

You may create an account using email/password or by signing in with Google or Apple. You are responsible for maintaining the security of your account credentials.

3.2 Account Responsibilities

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized account access
• Accept responsibility for all activities under your account

3.3 Account Termination

You may delete your account at any time through the Account screen. We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content and Reviews

4.1 Review Guidelines

When submitting reviews on Rentalk, you agree to:

• Provide honest, accurate reviews based on your genuine rental experience
• Review only properties you have personally lived in or visited
• Not post false, misleading, or defamatory content
• Not include personal information of landlords or other tenants
• Not use offensive, abusive, or inappropriate language
• Not post duplicate or spam reviews
• Comply with all applicable laws and regulations

4.2 Location Verification

Rentalk may use location data to help verify review authenticity. Providing your location when submitting a review is optional but recommended, as it helps maintain the integrity of our platform. If you choose to share your location, you consent to it being recorded at the time of submission.

4.3 Review Ownership and License

You retain ownership of your reviews. However, by posting content on Rentalk, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content in connection with our services.

4.4 Content Moderation

We reserve the right to review, edit, or remove any content that violates these Terms, including reviews that:

• Contain false or misleading information
• Violate privacy rights or intellectual property
• Include hate speech, harassment, or discrimination
• Promote illegal activities
• Contain spam or commercial solicitation

4.5 Reporting Violations

If you believe content violates these Terms, report it through the app or contact us at support@rentalk.app.

5. Prohibited Activities

You agree not to:

• Use Rentalk for any illegal purpose
• Impersonate others or provide false information
• Post fake reviews or manipulate ratings
• Harass, threaten, or abuse other users
• Scrape, data mine, or collect user information
• Reverse engineer, decompile, or attempt to extract source code
• Interfere with or disrupt the app's functionality
• Upload viruses, malware, or harmful code
• Create multiple accounts to circumvent restrictions
• Use automated tools or bots without authorization

6. Intellectual Property

6.1 Rentalk Property

All content, features, and functionality of Rentalk (including but not limited to software, text, graphics, logos, and design) are owned by Rentalk and protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use Rentalk for personal, non-commercial purposes in accordance with these Terms.

7. Third-Party Services

Rentalk integrates with third-party services including:

• Google Maps API for location services
• Google and Apple for social sign-in
• Firebase for authentication and data storage

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services or their practices.

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using Rentalk, you consent to our data practices as described in the Privacy Policy.

9. Disclaimers and Limitations

9.1 "As Is" Service

9.2 Content Accuracy

Reviews and property information are user-generated content. We do not verify the accuracy of all reviews and make no representations or warranties about:

• The accuracy, reliability, or completeness of reviews
• The quality or condition of properties listed
• The behavior or integrity of users, landlords, or property managers

9.3 Service Availability

We do not guarantee that Rentalk will be available at all times, uninterrupted, or error-free. We may suspend, modify, or discontinue services without notice.

9.4 Limitation of Liability

You agree to indemnify, defend, and hold harmless Rentalk, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use of Rentalk
• Your violation of these Terms
• Your violation of any rights of another party
• Content you post or submit

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to conflict of law provisions.

11.2 Informal Resolution

Before pursuing formal legal action, please contact us at support@rentalk.app to attempt to resolve the dispute informally.

11.3 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with Australian arbitration laws, unless prohibited by applicable law.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the app or via email. Your continued use of Rentalk after changes are posted constitutes acceptance of the modified Terms.

13. Termination

13.1 Termination by You

You may terminate your account at any time by using the account deletion feature in the app or contacting support.

13.2 Termination by Us

We may suspend or terminate your account immediately if you:

• Violate these Terms or our policies
• Engage in fraudulent or illegal activities
• Pose a security or legal risk
• Fail to comply with applicable laws

13.3 Effect of Termination

Upon termination:

• Your right to use Rentalk will cease immediately
• Your personal account data will be deleted
• Your reviews will be anonymized (not deleted, to preserve community data)
• Provisions that should survive termination will remain in effect

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rentalk regarding your use of our services.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
